I, the undersigned applicant, and the Company, for and on behalf of itself and all of its employees, mutually contract and agree that in consideration of the company entertaining this application, all claims, dispute, differences and controversies between them, including, but not limited to employment, civil rights, discrimination and retaliation claims shall exclusively be resolved and settled through final and binding arbitration. The arbitrators shall have the sole and exclusive right to decide and determine all issues of arbitrability and jurisdiction. The parties stipulate and agree that all arbitrations shall be pursuant to the Federal Arbitration Act, any claim to a right of trial by jury and appeal is waived and judgment upon an Award may be entered in any court of jurisdiction state or federal. The parties agree that any party who attempts to avoid, evade, delay, frustrate and/or in any way not to comply with the arbitration procedure shall be liable to all other parties and beneficiaries of this agreement for all attorneys fees, costs and expenses incurred to secure compliance with this dispute resolution agreement.
